CAD Contest 2010 rules

1. PURPOSE

1.1 The Vision numeric company, a Simplified Joint Stock Company with a share capital of euros 710 650, registered with the Register of Commerce under the number LYON B 345 009 427, whose registered office is situated La Giraudiere D389 69690 BRUSSIEU - France (hereinafter referred to as "Vision numeric"), and Europäische Akademie der Juweliere Gold- und Silberschmiede GmbH FBZ Ahlen, a training center with registration number (hereinafter referred to as FBZ) are here by designated "Organisers". Vision numeric and FBZ are organising a CAD contest (hereinafter referred to as "The Operation") that will be circulated only on the Internet, on the website www.3design.com (hereinafter referred to as the "Site").

1.2 The Operation will be circulated in every country for every customer who bought at least one CAD license and to all students whose school had bought at least one Master CAD license. The contest period is: from 11 June 2010 to 26 July 2010 inclusive.

1.3 The status of winner shall be subject to the validity of participant (hereinafter referred to as the "Participant") participation.

1.4 Participation in the Operation shall be construed as acceptance, without reservation, of the entirety of these rules (the "Rules"), ethics regulations in effect on the Internet as well as legislation and other texts enforceable in France.

2. PARTICIPANTS

2.1 This contest is open to any physical person who is over 18 (eighteen) years of age who purchased at least one CAD license. The professional activity of the participants has to be related to jewellery, fashion accessories or design fields. Staff from Vision numeric, its distributors, FBZ and the jury members are excluded out of the contest.

3. OPERATION CIRCULATION

3.1 To take part in the Operation, the Participant must register through the form available at http://3design.com/campagnes/2010/contest/contest_2/form_cad_contest.php during the operation period from 11 June 2010 to 26 July 2010 inclusive.
Participation will take place solely on the Internet and by email. Hence, any other means of participation such as fax or mail will be rejected. The contest is to create a maximum of 5 designs with a CAD software on the theme "Silver & Diamond(s)".

The Participant has to:
> fill in the form on the web page mentioned above
> create his/her design(s) with CAD software
> make a rendering image of each project
> save it as a vtf , stl, iges or .step file and copy/paste both this file(s) and rendering image(s) into a FTP address provided by Vision numeric after the subscription
> send (a) picture(s) of the design(s) (any image format) by email to contact@3design.com before the 26 July 2010 inclusive.

3.2 Participation in the Operation will be construed as valid as of such time as Vision numeric verifies that the Participant sent his/her design(s) and has accurately completed the participation form, as stipulated in paragraph 3.1. Any incomplete or erroneous registration will avoid participation.

3.3 The Operation participation date is the date on which the participation form is registered by Vision numeric.

3.4 The closing date for participation in the Operation will be the 26 July 2010 inclusive at midnight local time of the participant's country. Any participation registered by Vision numeric after this date will not be taken into consideration.

3.5 By fulfilling the form thus entering the contest, participants expressly authorise Vision numeric and FBZ to use their name, files, designs and images and country of residence in the context of any promotional or advertising messages/events, irrespective of the support media, in France and other countries, for a term of (5) years, it being stipulated that such use shall not give rise to any rights other than participating in the contest. Designs might be produced (samples and a limited number of real pieces) by the Organisers for advertising and promotional purposes and to show actual and real results of the contest, in no event shall they be produced to be sold.

3.6 .vtf, .stl, .iges and .step files submitted for the Operation are to be used by Vision numeric and FBZ staff only. It is stipulated that such use shall not give rise to any rights.

4. DESIGNATION OF WINNERS

4.1 An international jury was chosen and is composed of the following members (this number can vary from 6 to 12):
> jewelry schools or training centers professors
> professional jewellers, goldsmiths or watch makers
> software engineers
> marketing / sales people

This jury will select the 5 best design regarding the following criteria and assign FIVE winners:
> quality of the rendering
> creativity of the piece
Note that sets (including at least 2 (TWO) of these elements: rings, earrings, pendent, bracelet, watch, necklace) are permitted.

The first prize is a 2200 (euros) discount, valid one year (at official end date of the Contest) on the purchase of any product or service provided by Vision numeric and a 300 (euros) discount for seminars provided by FBZ Ahlen, Germany, valid one year (at official end date of the Contest).

The second prize is a 1200 (euros) discount, valid one (at official end date of the Contest) on the purchase of any product or service provided by Vision numeric and a 300 (euros) discount for seminars provided by FBZ Ahlen, Germany, valid one year (at official end date of the Contest).

The third prize is a 800 (euros) discount, valid one (at official end date of the Contest) on the purchase of any product or service provided by Vision numeric and a 300 (euros) discount for seminars provided by FBZ Ahlen, Germany, valid one year (at official end date of the Contest).

The fourth prize is a 600 (euros) discount, valid one (at official end date of the Contest) on the purchase of any product or service provided by Vision numeric and a 300 (euros) discount for seminars provided by FBZ Ahlen, Germany, valid one year (at official end date of the Contest).

Winners name will be published on the website www.3design.com and through Press Releases within 2 (two) months following closure date of participation.

The jury will select the best design regarding the same criteria and assign ONE winner a special award to a Participant. This special award is a 300 (euros) discount for seminars provided by FBZ Ahlen, Germany, valid one year (at official end date of the Contest).

4.2 By entering the contest, all Participants expressly authorise Vision numeric to use their name, files, designs and images and indicate their town and country of residence, in the context of any promotional or advertising messages/events, irrespective of the support media, in France and other countries, for a term of (5) years, it being stipulated that such use shall not give rise to any rights other than participating in the contest. Designs might be produced (samples and a limited number of real pieces) by the Organisers for advertising and promotional purposes and to show actual and real results of the contest, in no event shall they be produced to be sold.

5. ALLOCATION OF PRIZES

5.1 In total, 5 prizes will be allocated (details in articles 4.1).

5.2 Winners will be informed by e-mail, and will receive their invitation within four months following the draw. Indication of an erroneous address by the winner shall entail his/her disqualification. In the event that a prize is returned to Vision numeric and/or FBZ for whatever reason, the winner will be construed as having surrendered his/her prize. Vision numeric and FBZ hereby reserves the right to dispose of said prize freely. Under such circumstances, no claim by the winner will be admissible and the prize(s) will remain the property of Vision numeric and/or FBZ.

5.3 The winner shall not be entitled to issue any challenge whatsoever as regards the prize offered, nor may he/she request the cash equivalent of any prize, nor replacement nor exchange of said on any grounds whatsoever, subject to application of the guarantee covering each prize.

5.4 The cash equivalent indicated for prizes is expressed in euros and corresponds to the market price after tax applied at this time or evaluated on the date on which the rules were drafted, it is provided for reference purposes only and is exposed to variation.

5.5 Before receiving his/her prize, the winner must fulfil the conditions stipulated in the Rules and provide proof of identity

5.6 Vision numeric and FBZ hereby reserve the right, if applicable, to replace one or other of the prizes with another prize of at least equivalent value or by its cash equivalent, at Vision numeric's and/or FBZs discretion.

5.7 Any product names or brands mentioned are patented brand names of their respective owners.

6. LIMITED LIABILITY

6.1 Participation in the Operation shall be construed as familiarity with and acceptance of the Internet features and limitations, notably as regards technical performance efficiency, and consultation, inquiry or data transfer response times, risks of interruption, and more generally, risks intrinsic to connecting to and transmitting information over the Internet, the lack of measures to protect some data against possible fraudulent use and risks of contamination by viruses that may be circulating on the net.

7. FORCE MAJEURE / PROLONGATION RESERVE

7.1 Rules will be enforceable against each person participating in the Operation.

7.2 In the event of Force Majeure or an incident beyond the control of the organisers resulting in modification, shortening or cancellation of the Operation, the liability of the organisers will not be engaged. The organisers hereby reserve the right in any circumstances to extend the period of participation and to postpone any date announced.

7.3 The amended version will enter into effect as of such time as it is put on line. Participation in the Operation as of the date on which the amended version enters into effect shall be construed as acceptance of the amended rules. Any Participant that refuses the modification(s) made should terminate his/her participation in the Operation.

7.4 Vision numeric and FBZ hereby reserve the right to sue any person committing fraud or attempting to do so. Vision numeric and FBZ will not however be liable in any way towards any Participants for any fraud that may be committed.

7.5 Provision of a false identity and/or address by Participant shall result in their exclusion from the Operation.

7.6 In the event of a breach committed by a Participant, Vision numeric and FBZ hereby reserve the right to set aside in full right any participation from the latter, without such a Participant being entitled to make any claim whatsoever.

8. NOMINATIVE DATA

The details of each Participant will be used in accordance with the provisions set out in the "Informatique et Libertés" ( IT and Freedom) Act dated the 6th of January 1978. Each Participant shall have the right to access, rectification or deletion of information pertaining to him/her upon simple request forwarded to Vision numeric at the following address: contact@3design.com.

Vision numeric and FBZ need the nominative data gathered on the participation form for the Participant's participation in the Operation to be taken into consideration. This nominative data may be used by Vision numeric and FBZ to present their products and/or services, unless the participant formally refuses said. Upon filling in the participation form, the participant may indicate that he/she does not wish to receive information from Vision numeric and FBZ on his/her email address by ticking the relevant box.

9. JURISDICTION OF COMPETENCE AND CONSTRUCTION

9.1 The Rules will be ruled and construed exclusively under French Law and are available in the English language for the other countries participating in the Operation.

9.2 Any question relevant to enforcement or construction of the Rules, or any unforeseen question that may be raised, will be finally decided by Vision numeric and FBZ depending on the type of question, in accordance with French Law.

10.4 No request received by Vision numeric by telephone or mail pertaining to the contest will be responded to.
